Terms & Conditions

The Montique website and services are made available to you in accordance with the following Terms of Use & Service (TOS).

By visiting www.montiqueclothing.com or www.montiqueclothing.com.au you are accepting and consenting to these TOS. We may modify the TOS from time to time, and your continued use of this site following such changes shall signify your agreement to be bound by the modified TOS.

In particular, we draw your attention to our policies relating to the terms of purchase as outlined in this TOS and our Privacy Policy. If you are under 18, you must let your parent or guardian know about our Montique Privacy Policy before you register to use this site or the site's services.

Please read the TOS and check back often. If you do not agree to any change to the TOS, then you must immediately stop using the site.

REGISTRATION

To use some of the services or features made available to you on this site, you will need to register. We may change our registration requirements from time to time. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. Should any of your registration information change, please notify us immediately at the following e-mail address customerservice@intermoda.com.au. You may also want to view our Privacy Policy.

ELIGIBILITY OF PURCHASE

The purchase of Montique merchandise is strictly limited to parties who can lawfully enter into and form contracts on the Site.

In order to make purchases through the Site, you will be requested to register and provide your personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided.

The Site is available only to individuals and others who meet the Montique terms of eligibility, who have been issued a valid credit card by a bank acceptable to Montique, whose applications are acceptable to Montique and who have authorised Montique to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Purchases made on the site are for personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. Montique reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.

Moreover, by making an offer to purchase merchandise, you expressly authorise us to perform credit checks and, where Montique feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time.

ORDERS

All orders are subject to availability. Products for sale are in stock and available for dispatch from our online store. Montique strives to fulfil all orders, however in the case an order cannot be fulfilled you will be notified within 48 hours.

When you place a Montique order you enter into a sales contact, if you wish to cancel you are liable for any shipping and handling charges incurred by Montique. The completion of the contract between you and Montique is finalised once we dispatch the goods to you.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set-out above.

Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the site whether or not that merchandise has been sold; removing, screening or editing any materials or content on the site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

ORDER CANCELLATIONS/AMENDMENTS

Once your order is complete it’s instantly sent to our dispatch system to begin picking your items and getting them shipped to you as soon as possible. This leaves a fairly short window in which we can cancel, change or remove items from your order.

We are unable to swap items on a completed order, but items can be removed prior to shipping providing you contact us within 12 hours of placing your order.

If you need to cancel, change the shipping address or remove items from your order please contact the Customer Service team as soon as possible. We cannot guarantee it will be possible to reach your order in time, however if you contact us within 12 hours of placing your order we will endeavour to amend your order as per your request. If an order is returned back to us due to an incorrect or incomplete address, we will need to contact you to process a new shipping fee for re-delivery. 

Any orders that you may want to cancel once dispatched need to be returned at your own expense. If you choose to cancel once it has been sent out, shipping fees are non-refundable.

PRIVACY POLICY

We at Montique value your right to privacy. We have developed Privacy Procedures for the collection and storage of personal information that comply with Privacy Legislation in Australia.

The information collected is protected from unauthorised access, loss, misuse, disclosure or alteration. We do not provide or sell personal information to other organisations.

We take care to ensure that the personal information you give us on our website is protected.

You may be able to access external websites by clicking on links we have provided. These websites are not subject to our privacy standards, policies and procedures. You will need to contact or review these websites directly to ascertain their privacy standards, policies and procedures.

CUSTOMER PROFILES

When you submit your personal information using the Sign Up Form, all information is retained solely for our internal records. Where customers agree to being contacted, this information is utilised to send relevant information, and to assist our understanding of our customers’ preferences and product requirements.

WEBSITE

When you visit the Montique website, information is collected relating to some aspects of your visit. This information cannot be used to identify an individual and is used only to provide us with an understanding of how users interact with the website. This information includes web pages viewed; the amount of time spent viewing the site; the type of browser; a visitor’s country of origin.

Changes to this Privacy Policy

We reserve the right to change our Privacy Policy from time to time. If we decide to change our Privacy Policy, we will post those changes on our site so users are always aware of what information we collect from them, how we use it, and under what circumstances.

If at any point we decide that we wish to use personally identifiable information collected from our users in a manner that differs from that stated at the time this information was collected, we will notify users by way of an email. Users will have a choice whether or not to consent to our using their personal information in accordance with our updated privacy policy.

PAYMENT

Prices shown on the site are in AUD$ and are inclusive of GST.

All prices and offers remain valid as advertised from time to time. The AUD$ price of a product displayed on the website at the time the order is accepted will be honoured.

Montique Payment can be made by Visa, Mastercard, Paypal, Humm or Afterpay. Payment will be debited and cleared from your account upon receipt of your order by Montique. You confirm that the account that is being used is yours. All account holders are subject to validation checks and authorisation by the account issuer.

If the issuer of your payment refuses to authorise payment to Montique, we will not be liable for any delay or non-delivery.

We take all reasonable care to make our site is as secure as we can make it. All transactions on this site are processed using SecurePay's Payment Servers, a secure online payment gateway that encrypts your account (card) details in a secure host environment.

To help ensure that your shopping experience is safe, simple and secure Montique customers account information is never openly stored within the SecurePay System.

Transaction data is stored with a truncated PAN-- an abbreviated version of the credit card number --so that merchants can still distinguish transactions, while account (card) details are never stored.

Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

AFTERPAY

Afterpay is a service that allows flexible payment plans for online purchases. Shop the pieces you want now and pay it off in four equal payments over 8 weeks.

To use Afterpay you must:

  • Have an Australian residential address
  • Pay with a credit or debit card
  • Be over 18 years old

Using Afterpay for the 1st time

  • Add garments to your shopping bag to the maximum of $1000
  • Choose Afterpay as your payment method at checkout
  • You will be prompted to create an Afterpay Account and confirm and pay the first of four instalments up front

Additional Information:

  • Funds for the first payment made using Afterpay must be available on your credit or debit card at the time of checkout. (First payment will not occur until 14 days after checking out.)
  • If you wish to return your purchase partially or in full please adhere to our online returns and exchanges process. Should your order be eligible for a return your initial payment will be refunded and the remainder (3 payments) will be cancelled at no charge.
  • If you fail to make a payment you will be charged a late fee of $7 by Afterpay which is non-refundable. Further each week you fail to pay after the initial $7 late fee an incremental $10 late fee will apply for each week the payment is overdue.
  • All sale items purchased on AfterPay will be store credited or exchanged as per our Shipping + Returns policy. Therefore the payments will continue as per schedule and a store credit will be emailed to you.

ZIP PAY

We have partnered with Zip Pay to offer flexible and secure payment options that allow you to buy and enjoy your new clothing now and pay later. It is quick and easy to use.

How Does Zip Pay work?

At the end of each month, you can choose to pay off your balance in full or make a partial payment that suits your budget  (note: there is a minimum repayment amount of $40 per month). A monthly service fee of $6 applies but this fee is waived if you pay your balance in full by your due date.

To ensure you never miss a payment, just log into Zip Pay and set up a direct debit to make automatic repayments. You must pay the minimum of $40.00 each month and payments can also be paid online by debit card, credit card or BPAY.

If you wish to return your item(s) simply place your return by following our normal process and you will be refunded to your Zip Pay.

INSURANCE AND DELIVERY

Montique insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Montique and transfer of responsibility in the same way.

WAREHOUSE SALE/OUTLET

Items purchased during the Warehouse Sale or from the Outlet are final and cannot be returned for a refund, exchange or store credit, unless the item/s received are faulty. 

LADY LUCK PROMOTION

Purchase a category and a size with Lady Luck and we uniquely pack three surprise garments of the same size for you. Each order is individually curated with styles that are from our one off range and are no longer available online, while others may be our most popular styles.

Lady Luck is a final sale and is not eligible for a return, credit note, exchange and/or refund, unless the item/s are deemed faulty by Montique. Please contact us if you have any issues regarding your order. This promotion runs for limited times only. This offer cannot be used in conjunction with any other offer, discount, sale code or promotion. 

While we endeavour to follow your special requests, Lady Luck is a surprise collection of dresses and as such we cannot guarantee that your requests can be met. 

FLASH SALE $99 DRESSES

Offer is valid on selected styles only. Styles purchased under the Flash Sale are not eligible for a return, refund, exchange or credit note unless deemed faulty by Montique. This offer cannot be used in conjunction with any other offer, discount, sale code or promotion and runs for a limited time only. 

$150 off Selected Coats

The $150 off Coats is eligible for the following selected styles only - our Anoushka Faux Fur Suede Wrap and Montmare Fur Trim Knit. BRIDESMAIDS PACKS

For custom colours, please place your order for all bridal party members together to avoid any variation in dress colour.

Styles that have been customised cannot be returned.

We cannot ship dresses in a single order to separate locations.

All bridesmaids packs are eligible for a return within 14 days for a refund, credit note or exchange, as long as they are unused, with original tags attached.

Prices will be adjusted if you keep less garments than originally purchased.

COVID-19 Important Notice for Shipping

While we endeavour to ensure that your order is delivered as swiftly and quickly as possible, our carriers Australia Post and Couriers Please are encountering delays due to factors like fewer flights, international delays, increased volume of parcels. As such, please allow up to an additional three business days from the estimated delivery date. Due to flight restrictions and extremely limited international flights, international parcels are also being significantly delayed. Please allow extra time for International deliveries. 

Due to the implementation of COVID-19 safety measures, Australia Post and Couriers Please are not offering a signature on delivery service and are instead providing contactless delivery. They will leave the parcel at your door if it is safe, if not a card will be left with instructions on how to pick up your parcel from their closest collection point. We are not responsible for any lost or missing parcels and cannot provide compensation once delivered due to this implementation.

Express Domestic Post (within Australia) is still available and is the fastest way to receive your order. Our warehouse packs Express as a priority, however please allow extra time for the delivery, especially for rural areas. 

Australian Deliveries

You will receive a shipping confirmation email as soon as your order leaves Montique

    • Standard shipping is a flat rate of $9.95 

    • Express shipping is a flat rate of $16.00

    • Same day delivery pricing is available in selected Sydney suburbs and cost is calculated at the checkout based on delivery postal address. For courier delivery options, please contact us directly. 

    • All orders over $299 within Australia will receive free standard shipping.

    • For standard shipping please allow 4-7 working days to receive your delivery.

    • For express shipping please allow 2-5 working days to receive your delivery.

    • Credit Notes do not cover your shipping cost unless your order is over $299.

    • Please note that during busy promotional and sale periods some order dispatches may be delayed due to the additional volume.

    • These delivery dates and times are our best estimate only and we are not liable for any loss due to unforeseeable delay in delivery. 

    • Orders are shipped from Sydney, Australia. In some instances they may be shipped from a different location in Australia.

    • We must have correct and complete addresses, including a company name where necessary, and at least one contact telephone number.  

    International Deliveries

    Montique happily ships to most international destinations. For delivery international shipping the following applies;

    •  Orders to New Zealand are charged at a flat rate of $29.95

    •  Orders are shipped from Sydney, Australia. In some instances they may be shipped from a different location in Australia.

    •  Please allow up to 14 days to receive your order. Please note, due to COVID-19 flight restrictions our carriers are experiencing delays. Please allow extra time for International deliveries.

    • To guarantee delivery it is best to send your parcel to your office or somewhere where there will be someone to receive it between 9am - 5pm. If there is no one at the delivery address your order is placed in a safe place outside your address unless specified otherwise. For some international countries, customs will require you to collect it from a collection point and a card will be left for further information. Any custom duties are charged to you upon delivery or collection.

    •  We must have correct and complete addresses, including a company name where necessary, and at least one contact telephone number

    •  Duties and taxes will be charged to the receiver upon delivery.

    •  We are not responsible for any duties or taxes and any re-delivery requires a new shipping fee. 

    • Montique may in certain cases contact you to provide validation of shipping address and your credit card details.

    RETURNS

    Return Conditions

    Items that are returned must be: 

    • Returned to our online address within 14 days of receipt
    • Unused and unworn
    • In their original condition without damage or alteration
    • With the Montique tags still attached
    • Not an ineligible product due to sale condition or hygiene reasons (please see the products below) 
    • Returned with proof of purchase, a corresponding order number or receipt

      Returns that do not meet these conditions will not be accepted and may be returned to you at a further cost.

      To return a garment, we do not provide return postage and this must be paid prior to dispatch by the customer. For faulty or incorrectly received items, we offer free return shipping at our discretion. 

      Full price items can be returned for a refund, credit note or exchange. 

      From 25th November 2020, Sale items can only be returned for an exchange. They are not valid for a refund or credit note. Please see below for further information. For any purchases placed 14 days prior to the 25th November, sale items are accepted for a credit note or exchange only. 

      Items purchased online cannot be returned in-store, and items purchased in-store cannot be returned to our online address. 

      Any refunds will be returned to you in the manner you paid for the item, including debit or credit card, Afterpay, Paypal, Humm and/or an online store credit). For example, if you paid with an online credit note, you will be reissued a new credit note. This also applies to full price items where a credit note was used. 

      Shipping and handling charges are non refundable.

      We are not responsible for lost or damaged returned parcels and cannot provide compensation if your return is lost in transit. We cannot accept returns sent via a courier as our returns address is an Australia Post Office PO Box location. Please ensure you keep a copy of your lodgement receipt for tracking purposes.

      FULL PRICE ITEM RETURNS
      Full-price items are any items that have not been marked down. Full price items can be returned to our online office address for a refund, exchange or credit note, as long as they meet the return conditions above. 

      If a full price item has a promotional code applied to it, it can still be returned for a refund unless specified in our terms and conditions. Full price items purchased with an online store credit can be returned for an online store credit or exchange only. 

      SALE ITEM RETURNS

      From 25th November 2020, sale items can only be returned for an exchange.  Sale items cannot be returned for a refund or credit note unless deemed faulty by Montique. We accept change of mind sale items for an exchange to another size only. If your preferred size is unavailable, we can provide an exchange to another style of equal value. 

      BLACK FRIDAY SALES

      Styles purchased under the Black Friday Take a Further 50% Off promotion Sale Collection are final sales and cannot be returned for a credit note, exchange or refund unless deemed faulty by Montique. 

      Ineligible Products/Non-returnable items
      Any garment/s purchased during a Warehouse Sale, Black Friday Take a Further 50% off, Flash $99 Sale, or during our Lady Luck Promotion cannot be returned for a credit note, refund or exchange unless deemed faulty by Montique. For hygiene reasons, earrings cannot be returned unless deemed faulty by Montique. 

      How to Return an Item to us:

      1. Complete the return form included with your order and securely repackage your garments. If you did not receive a form please check you are eligible for a return, then print the RETURNS FORM. Be sure to cover or remove any original mailing address label or carrier barcodes from the package.
      2. Send your return package to our Head Office Return Address:

      3. Ship your package using a trackable, insured shipping method. We cannot accept responsibility for packages we do not ship. Please keep the tracking details or lodgement receipt for your records.
      4. You will receive an email once your return has been processed. Please allow 5 business days from the time we receive your return for it to be processed. Your return will be processed in accordance with our return policy. 

      Please note that our returns are delivered to a safe PO Box location and are picked up on a weekly basis. As such, please allow 14 days for your return to be processed by our team from postage. 

      EXCHANGES
      We will offer one free shipping on your first exchange order, this applies to exchange orders shipped within Australia only. This free exchange does not apply to the Lady Luck promotion, Flash Sale promotion, Warehouse Sales, Outlet items or late returns that are accepted at the discretion of Montique. International exchange shipping charges or duty taxes will need to be paid by the customer before the exchange item(s) are dispatched from our warehouse. For all other exchanges, we will contact you to process your shipping fee and/or any outstanding amount for the difference in payment. 

      LATE RETURNS

      Returns must be sent back to us within 14 days of receipt. Items returned to us after this period will not be accepted and will be sent back to you. 

      CREDIT NOTE CONDITIONS

      Credit notes are valid for 12 months from their issue date. After the 12 months your credit note will expiry and cannot be re-issued. Credit notes do not cover shipping charges and are not transferable. Credit notes are only valid for our online website and cannot be redeemed in store. 

      FAULTY GARMENTS
      Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within six months of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty.

      Our quality control team at Montique ensures high standards and procedures to ensure every garment is checked before dispatching it. In the unlikely chance that you believe your garment is faulty, or you have received the incorrect item, please contact us as soon as possible. For any email correspondence, please include a photo of the fault so our team can assess it.

      If we at Montique deem the garment as faulty, we are able to provide a replacement, repair or refund. For minor faults, we offer a repair or replacement within a reasonable time. If there is a major fault that cannot be repaired or replaced, then we are able to provide a refund. In the case where the faulty garment needs to be returned back to us, we provide free return shipping. This is in accordance with Australian Consumer Law. 

      Please note that we can refuse a repair, replace or refund if we find that:

      • the garment has no reasonable fault
      • the damage or fault has been caused by customer misuse, fair wear and tear or failure to follow cleaning instructions 
      • you purchased the garment understanding it was flawed or faulty at the time of purchase
      • there has been a substantial amount of time between the purchase date and the acknowledgement of fault

        SALES AND PROMOTIONAL CONDITIONS
        Once an order has been processed, the purchase price is final. We cannot honour any promotions that occur after your purchase. 

        INTELLECTUAL PROPERTY RIGHTS

        You acknowledge and agree that all copyright, designs, trademarks and all other intellectual property and material rights relating to the Content as herein described in this Site, shall remain at all times vested in Montique. All such Content displayed on this Site is protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Montique. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties.

        CONTENT

        In addition to the Intellectual property rights mentioned above, Content is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. Montique tries to ensure that the information on this site is accurate and complete.

        Montique does not warrant that the functional aspects of the Web Site or Montique Content will be error free or that this Web Site, Montique content or the server that makes it available are free of viruses or other harmful components. If your use of this Web Site, or Montique Content results in the need for servicing or replacing property, material, equipment or data, Montique is not responsible for those costs. Without limiting the foregoing, everything on the Web Site is provided to you "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
